1. Who this notice is for
This notice explains how Netyark Mall handles personal information when you browse netyarkmall.com, sign in, order as a guest or account customer, subscribe to offers, or contact our team. Netyark Mall is responsible for deciding how that information is used for these services. Use the contacts below for privacy questions or requests.
The store uses a shared backend with its administration dashboard and mobile app. Staff access is permission-controlled. This notice describes the website; where you choose a mobile-app feature, such as push notifications, the relevant device permissions also apply.
2. Information we collect
The information depends on what you choose to do:
- Browsing and security: IP address, browser/device information, installation and session identifiers, request times, error information and activity needed to operate and protect the service.
- Account access: your phone number, verification status and sign-in/session records. Optional profile details can include your name, email, avatar, birthday and gender; those optional fields are not required merely to verify your phone.
- Shopping and orders: cart items, chosen product options, wishlist, orders, amounts, discounts, payment references/status and the contact/delivery details you supply. Order records preserve the item and address details as they were at the time of purchase.
- Delivery: recipient name and number, country, region, town, area and street address; optional landmarks, GhanaPost GPS address, instructions and coordinates if you provide them.
- Support and subscriptions: messages or attachments you send us, newsletter email addresses, communication preferences, and records of the terms accepted or notices acknowledged. Do not put payment secrets or unnecessary sensitive information in these fields.
- Optional image search: a photo you choose to take or upload is processed to find visually similar catalogue items. Camera or file access is requested by your device when needed; simply visiting the site does not activate your camera.
3. Why we use it
We use necessary information to verify account access, remember shopping choices, calculate and fulfil orders, reconcile payments, send service updates, arrange delivery, respond to support requests, prevent fraud and keep records. We also use order and stock data to prepare business reports.
The applicable basis may be performing a contract or taking steps you request before an order, a legal obligation, an appropriate legitimate interest such as protecting the service, or your consent where it is required. We do not treat every use of information as consent-based, or treat a sign-in checkbox as unrestricted permission.
If you do not provide required phone verification or checkout details, we cannot provide the feature that needs them. You can still browse without an account, and checkout as a guest without completing an account profile.
4. Payments and order updates
Paystack processes payments. We send the checkout information it needs, including an email address, transaction reference, amount and relevant order metadata, and receive payment status and limited transaction information for reconciliation. Card details and payment authentication are handled on Paystack’s payment interface, not collected through Netyark’s product or checkout forms.
Arkesel and mobile networks deliver phone verification and transactional SMS. Order messages use the recipient/order number supplied at checkout for both guest and account orders. These service messages are distinct from promotional messages. Account notification history and mobile push, where enabled, provide additional updates.
Never send us a full card number, CVV, OTP or mobile-money PIN in a support message. Contact the payment provider or your bank promptly if you suspect payment misuse.
5. Marketing is your choice
Newsletter signup has a separate, unticked opt-in. Signing in, acknowledging this notice or buying an item does not subscribe you to marketing. Account marketing and notification preferences can be changed in the account settings where offered.
To stop newsletter emails, contact Netyark@gmail.com using the subscribed email address. Our team can mark the subscription as unsubscribed. Withdrawing marketing consent does not undo earlier lawful processing or stop messages necessary for an active order or account security.
6. Cookies and storage on your device
The website uses essential cookies to maintain secure sign-in, protect requests, carry a short-lived verification flow and retain guest order access. Browser storage also holds guest cart choices, a random installation identifier and limited shopping/session-recovery state. Authentication and guest order-access credentials are kept in protected cookies, not exposed as ordinary JavaScript storage values.
You can clear or block cookies and site storage in your browser. Doing so can sign you out, remove a guest cart or prevent access to a guest order from that browser. Keep your order number and contact support if you need help. Some functions cannot work with all essential storage blocked.
The built-in help panel does not contact the external chat provider until you choose to open live chat. If tawk.to chat is enabled and opened, that provider receives connection information and your chat content and may use its own cookies or storage. You can use phone or email instead. Any future optional advertising or analytics tracking needs its own notice and any required choice; this notice is not blanket consent to it.
7. Who receives information
Information is shared as needed for the services described here, not made public merely because you place an order. Relevant recipients include:
- Authorised Netyark staff, and delivery/fulfilment personnel who need the details required to handle your order.
- Paystack and relevant financial/mobile-money providers for payment processing; Arkesel for SMS; and email or push providers when those communication features are used. Resend supports configured email delivery, including staff account recovery.
- DigitalOcean for application, database and file hosting; Cloudflare for domain services and any configured delivery/security functions; and authorised technical service providers maintaining the platform.
- tawk.to when you open an enabled live chat, and Google Cloud Vertex AI to process your photo when you choose an enabled image-search feature.
- Authorities, professional advisers or other parties where disclosure is legally required or necessary to investigate fraud, establish or defend rights, or address a security incident.
8. Where information is processed
The platform uses DigitalOcean infrastructure, including services in the London region. Other service providers may process information outside Ghana. Cross-border processing does not remove our responsibility for the information. Appropriate contractual, security and other safeguards must apply under Ghana’s data-protection requirements.
External payment and chat providers explain their own processing in their privacy notices. Contact us for information about the providers and safeguards relevant to your request.
9. How long information is kept
Different records serve different purposes. Verification challenges and sessions expire. Guest cart information can remain in your browser until it expires or is cleared. Account, order, payment, support, security and acceptance records may need to be kept longer for fulfilment, accounting, dispute handling and legal obligations.
Closing an account or withdrawing marketing permission does not automatically erase completed orders or records we are legally required to retain. We assess deletion and retention requests by record type and explain any lawful reason for keeping information. Retention depends on the purpose of the record and applicable obligations; contact us about the period relevant to your information. Deletion from backups may not be immediate.
10. Protecting your information
The system uses encrypted connections, protected session cookies, verification-code safeguards, staff permissions and security/audit records. No website or transmission method is risk-free. Protect your phone, browser and email account, sign out on shared devices, and tell us promptly about suspected misuse.
If a personal-data incident requires notification, we will follow the applicable notification requirements. A privacy-policy checkbox is not a waiver of our security responsibilities.
11. Your choices and rights
Subject to applicable law, you can ask about the personal information held about you, request access or correction, object to processing, withdraw consent, and request deletion of information we are no longer entitled to keep. You may also raise concerns about decisions affecting you and ask for a person to review a problem.
Contact us using the details below. We may ask for proportionate information to verify your identity or authority, particularly for a guest order; we will not ask for your payment PIN or OTP. We will explain any legal limit on a request and respond within the applicable statutory timeframe.
You can complain to Ghana’s Data Protection Commission without first giving up any other available remedy. The Commission’s website is dataprotection.org.gh.
12. Children and information about other people
The store is not intended to solicit accounts or personal information from children. A parent or guardian should handle a purchase where needed. If you believe a child has supplied information without appropriate authority, contact us so we can assess it and take suitable action.
If you enter someone else’s delivery details, make sure you have authority to do so and let them know those details will be used to fulfil the order. Avoid unnecessary information in delivery instructions or image uploads.
13. Updates to this notice
The version and date identify this notice. We will update it when the service or our practices change. Where a new purpose requires fresh consent or notice, we will obtain it or provide it as required rather than relying on an earlier sign-in acknowledgement.
